Terms of Service

These Terms of Service ("Terms") govern your use of Cast-A-Booking, an appointment-booking service operated by Cast-A-Booking LLC, an Arizona limited liability company ("Cast-A-Booking", "the Service", "we", "us"). By creating a business account, subscribing, or using a business's booking page, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Cast-A-Booking provides an AI-assisted booking tool that lets appointment-based businesses — such as barbershops, salons, spas, pet groomers, and other local service providers — take appointments from their customers through a chat page or QR code. We provide the software and hosting; each business is responsible for its own services, prices, hours, team, and the appointments it accepts. Each business on the platform is independent: we are not a party to the appointment or to any transaction between a business and its customer, and we do not provide, supervise, or guarantee any business's services.

2. Who these Terms cover

Two groups use the Service: businesses (subscribers who manage a booking page) and customers (people who book an appointment with a business). Sections about accounts, billing, and promotions apply to businesses; sections about booking and data apply to both. You must be at least 18 years old and able to form a binding contract to open a business account.

3. Accounts and access

Businesses receive access to an owner dashboard, signed into with the account email and password chosen at signup. You are responsible for keeping your credentials secure and for activity under your account, including activity by team members you invite. Tell us promptly if you believe your access has been compromised.

4. Subscriptions, automatic renewal, and cancellation

Paid plans are billed on a recurring basis through our payment processor, Stripe. Your subscription renews automatically — monthly plans renew each month and annual plans renew each year, at the then-current price for your plan, and your payment method is charged at each renewal until you cancel. The price and billing frequency are shown before you subscribe.

Cancelling is as easy as subscribing: you can cancel online at any time from your dashboard's billing portal (Plan & billing → Manage billing), or by emailing us. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable and partial periods are not prorated. If a subscription lapses or is past due, the business's online booking is paused until payment resumes.

If a plan includes a free trial, we tell you the trial length before you start. Your payment method is charged automatically when the trial ends unless you cancel before then; cancelling during the trial costs nothing.

Prices and plan features may change; we will give reasonable advance notice of changes that affect an active subscription, and a price change never applies retroactively.

5. Client payments, refunds, and disputes

Businesses may optionally accept payments from their own clients at booking through a connected Stripe account. Those funds are collected by Stripe and paid out directly to the business; we never hold them. The business — not Cast-A-Booking — is the merchant for its client payments and is responsible for delivering its services, for its prices and cancellation policy, and for refunds owed to its clients. A business's cancellation policy, when set, is shown to the client on the payment page before they pay.

For plans below Premium, we charge a platform fee of 1% of each client payment, collected automatically via Stripe; Premium plans are charged no platform fee. This platform fee is in addition to Stripe's standard payment-processing fees, which are set by Stripe. If a business refunds a client's payment, the associated platform fee is refunded with it. Platform-fee rates may change with reasonable notice.

Payment disputes and chargebacks on client payments are handled through Stripe's dispute process, using the tools in the business's Payments dashboard. Businesses agree to Stripe's applicable terms, including the Stripe Connected Account Agreement, when they connect an account.

6. Promotions and referral rewards

We may offer discounts, coupons, promotional codes, and referral rewards. These are optional, may have conditions, caps, or expiration dates, may be changed or withdrawn at any time, and have no cash value. Referral rewards are issued as account credit applied toward future subscription invoices — never cash — and only after a referred business becomes and remains a paying subscriber for the required period. Rewards may be withheld for suspected abuse, self-referral, or fraud, and unused credit is forfeited when the earning account closes. Discount codes that a business creates for its own clients are that business's offer, not ours.

7. The AI assistant

The booking chat is an automated AI assistant, not a human, and it identifies itself as an assistant in the conversation. It works from the information each business configures (services, prices, hours, team). Like any automated system it can occasionally misunderstand or make a mistake; the booking confirmation shown after booking — and the business's own confirmation — are what govern the appointment's details. The assistant provides scheduling help only, not professional advice. If something looks wrong with a booking, contact the business directly or use your appointment link to review it.

8. Reminders and messages

The Service can send appointment-related messages on a business's behalf: booking confirmations, a reminder before the appointment, and — where the business turns them on — post-visit review requests and "we miss you" notes to lapsed clients. Depending on what a customer has shared and allowed, these are delivered by email, by browser/app notification (with the customer's permission, revocable any time in browser or device settings), or by text message where available. Marketing-style emails include an unsubscribe link, and unsubscribing never cancels an appointment. Businesses must only direct messages to clients they have the right to contact.

Text messages (SMS), where offered: if a customer provides a mobile number and opts in while booking, the Service can send that customer an automated appointment reminder text — typically one message about 24 hours before the appointment. Message frequency is limited to these reminders. Message and data rates may apply. Recipients can reply STOP to opt out at any time, START to opt back in, or HELP for help. These reminders are sent from a shared messaging number, so replying STOP or START applies across every business on our platform that uses it. We do not sell mobile numbers or SMS consent, or share them with third parties for their own marketing. Opting out of texts does not cancel an appointment.

9. Acceptable use

You agree not to misuse the Service, including: using it for unlawful purposes; attempting to disrupt, overload, or reverse-engineer it; uploading harmful code; probing or scraping it; or using it to send spam, unwanted marketing, or harassment. Businesses are responsible for having the consent or other lawful basis required to contact the clients they message through the Service. We may suspend or terminate access that violates these Terms.

10. No healthcare or protected health information

The Service is intended for general appointment-based businesses and is not designed for, and may not be used for, healthcare, medical, dental, mental-health, or other clinical purposes. You may not use the Service to create, receive, store, or transmit Protected Health Information (PHI) or any data subject to the U.S. Health Insurance Portability and Accountability Act (HIPAA) or comparable health-privacy laws. Cast-A-Booking is not a HIPAA "business associate," offers no Business Associate Agreement, and disclaims all liability arising from any use of the Service to handle health information. We may suspend or terminate any account that uses the Service for these prohibited purposes.

11. Customer data and privacy

Booking involves limited personal information (such as a customer's name and, if provided, phone number or email). As between a business and Cast-A-Booking, the business owns its client list: we process that information to operate the Service on the business's behalf, and businesses are responsible for handling their customers' information lawfully. Businesses can request an export of their data, and can delete appointment and client data from their dashboard or by contacting us. Our handling of data is described in our Privacy Policy, which forms part of these Terms.

12. Your content and our Service

Businesses keep ownership of the content they add — names, logos, photos, service menus, and similar material — and are responsible for having the rights to use it. You grant us a non-exclusive license to host, display, and process that content solely to operate the Service: showing it on your booking page, rendering it into share posters and link previews, and including it in messages sent on your behalf. We do not use your content for anything else, and the license ends when the content or the account is deleted, except for backups kept briefly in the ordinary course. The Service itself — its software, design, and branding — belongs to Cast-A-Booking and its licensors.

13. Availability and "as is"

We work to keep the Service available and reliable, but we do not guarantee it will be uninterrupted or error-free. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the extent permitted by law.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or bookings arising from use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the three months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

If you are a business, you agree to defend and hold Cast-A-Booking harmless from third-party claims arising out of your services, your content, your messages to clients, or your violation of these Terms or of applicable law — including claims by your own clients about the services they booked.

16. Dispute resolution and governing law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules. Cast-A-Booking LLC is organized under the laws of Arizona. If a dispute arises, contact us first at the email below — most issues can be resolved informally, and both sides agree to try in good faith for 30 days before filing anything. Disputes that can't be resolved informally will be brought in the state or federal courts located in Arizona, and both parties consent to their jurisdiction; either party may instead use small-claims court where its rules allow.

17. Changes, termination, and general terms

We may update these Terms from time to time. Material changes will be posted here with an updated date, and for significant changes affecting active subscribers we will also give notice in the dashboard or by email; continued use after a change means you accept the revised Terms. You may stop using the Service and cancel at any time. We may suspend or end access if these Terms are violated or if required to protect the Service or its users; where practical, we will give notice and a chance to export your data.

These Terms plus the Privacy Policy are the entire agreement between you and us about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of the business. Neither party is liable for delays caused by events beyond its reasonable control. These Terms are offered in English and Spanish; if the two versions ever conflict, the English version controls.
